These Terms of Service ("Terms") govern your use of the Underlisted website, apps, tools, and content (together, the "Service"), operated by Underlisted ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Underlisted is an information and research tool that helps everyday buyers understand U.S. homes: a plain-English Deal Score, fire and flood risk, the true monthly cost, and the cash you would likely need. It is a starting point for your own research, not a professional service.
Deal Scores, estimated values and rents, risk ratings, "true monthly cost," "cash needed," and similar outputs are estimates generated from public and third-party data and from our own models. They may be incomplete, outdated, or inaccurate for any specific property, and listings may change or sell without notice. You are responsible for independently verifying any information, including through a professional inspection and appraisal and by confirming details with the listing agent, lender, insurer, and public records, before you rely on it.
We identify public and licensed data sources so you can check our work. Naming a source does not mean that source is involved with, sponsors, or endorses us. Underlisted is a private business and is not affiliated with, endorsed by, or acting on behalf of the Federal Emergency Management Agency (FEMA), the Federal Reserve or the Federal Reserve Bank of St. Louis (FRED), the U.S. Census Bureau, the U.S. Department of Housing and Urban Development (HUD), the Federal Housing Finance Agency (FHFA), or any other government agency. Agency names are used only to describe where certain public data comes from.
Using the Service does not make us your real-estate agent, broker, lender, or fiduciary. If we introduce you to a licensed professional (for example, a buyer's agent, lender, or insurance agent), any decision to work with that person is entirely your own, and your relationship and any contract are with that professional, not with us. We may receive a referral fee or commission from partners; where required, we will disclose this.
We support fair housing. Our scoring never uses demographic characteristics or "neighborhood-quality" signals. You agree not to use the Service to discriminate against any person in violation of the Fair Housing Act or any other applicable law.
Some features may require a paid subscription. Prices, features, and billing terms are shown at the point of purchase and may change with notice. Payments are processed by a third-party provider; your purchase is also subject to that provider's terms. Unless stated otherwise or required by law, subscription fees are non-refundable for periods already started, and you may cancel future renewals at any time. "Founding" pricing, where offered, applies on the terms stated at signup.
The Service, including its design, text, logos, and software, is owned by us or our licensors and is protected by law. Third-party names and marks are the property of their respective owners. We grant you a limited, personal, non-exclusive, revocable license to use the Service for your own non-commercial purposes.
The Service may link to or rely on third-party websites, data, and services. We do not control and are not responsible for third-party content, products, or practices, and a link is not an endorsement.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY DATA WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You agree to indemnify and hold us harmless from any claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or any law.
We may change or discontinue the Service, and we may update these Terms, at any time. If we make material changes, we will update the "Last updated" date above. Your continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where applicable law requires otherwise.
These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce a right is not a waiver of that right. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours to a successor, for example in a merger, acquisition, or sale of assets. Section headings are for convenience only and do not affect interpretation.
